The World Government is known to be 'good' and the Marines system is created by the World Government much like the Police and Navy of our world. So people naturally would still view Tom as someone bad or a criminal who had aided and helped a 'notorious pirate' Gold D Roger built his ship. Tom asked the favour from the judge to pardon the crime for attacking the judicial ship and he will take the crime for building Roger's ship which is execution. Tom was taken to Ennies Lobby for execution. Iceberg had nothing to do with building Roger's ship and he was part of the crew that built the Sea Train that saved Water 7 economy and after he continued to built the place that's why everyone respected him.

ron about franky you're thinking a bit wrong about why people tolirate franky living there. They live in a world filled with pirates that are usually evil minded, we are used to see luffy and his friends but they still are outlaw pirate in the end :p . Franky's gang is actually a company as well . They are a demolition company that are also pirate hunters. They only attack pirates to claim the bounty and profit of the part from the pirate ship they demolish, they don't hurt any ppl living in water 7 unless provoked. To answer why he didn't yell about his innocence, Tom is a fishman, he is already persecuted for that, more so he is the one that built Gol D Roger's ship (you'll find out at some point if it's Gold or Gol D don't worry). He admitted to it and is proud of it, there is no way where him making scandal works out for him, the entire time to me personally seems like he decided he will die for this but wants to leave Franky and Iceberg healthy and in good standing with the marines so he cooperates even to his own death.

I believe the fishman prejudice hasn't really been addressed at this point in the story actually, we know this because even Nami is surprised that the fishman are discriminated later on. The only fishman activity we see prior to Tom is the Arlong Pirates, but thats just pirates harming innocent people, and that Arlong believes humans to be the inferior race. Nezumi might've said something, but its been a while since i watched those episodes. The Live action did change this slightly by addressing the discrimination in same arc. (pls correct me if i'm wrong)
