They were gonna be killed and the gotei 13 would've had no problem with it or anything to do with it. It's understandable why Shinji and the vaizards hold a grudge against them. They didn't even consider hearing out Kisuke explain Aizen's shikai. Also to answer Michelle's question, the two kids are mod souls created by Kisuke.

After dedicating their lives in service, they didn't even try to save them, Kisuke did. And the Shihouin clan can transform into cats, it's their "kekei genkai" to use a familiar term. Also Kisuke put the Hogyoku into Rukia's gigai, it was the thing preventing her powers from returning. Kisuke was already sentenced to the world of the living. Why would they go after him is the real question.
