Nothing to do with a claim, it's just about respecting any negative feelings it might cause for a friend. Not like it's some universal rule, it's just a mutual respect thing when you could pursue literally any other woman, and in their particular case you know that they didn't have a bad breakup and still have feelings for each other. The way Ted handles it isn't the right way either though, you're right there.

And I don't mean to sound prudish, but the way these people sleep around, why on earth should anyone care if Barney and Robin choose to hook up a full year and new serious girlfriend later? Does Ted get to keep some kind of sexual claim on Robin forever because she slept with him first? How many men has Robin gone through between Ted and Barney anyway? It's not like Barney pulled some trick on Robin. If anyone knows what to expect of him she does. And what does Stella think of her serious boyfriend kicking one of his best friends to the curb over another woman? I think Ted is being a real douchebag and his friends should call him out on it.
