The only way he could, would be to poison her, however its incredibly sus to hand someone a drink you openly have called out and disagree with. So he drank from the cup to prove it wasn't poisoned because who would willingly drink the poison. It was an act of martyrdom, however it backfired. if you notice the jewel begins to light up and pulse. (Oooo spooky magic)
