No one else mentions it but that is an enchanted cloak that emelia wore around capital earlier in season. when wearing it you can't be recognized. It's how she walked around city without attracking attention as a half elf. She also would use it when going to villiage of arlam sometimes. However during her fight with subaru, she actually threw the cloak at him at anger, that's why he had it. So in truth, he didn't steal it like he said :D (Also, i realize it's a 2 years too late comment but useful for anyone else who watches this later or even if you rewatch it one day or just want a missing piece filled in after the fact)
